Welcome to LEAD™ LMS, a comprehensive learning management system designed to facilitate and enhance the educational experience for both leaders and learners. By accessing or using our platform, you agree to be bound by these Terms of Service (TOS) and Privacy Policy. If you do not agree to these terms, please do not use our services.

1. Use of Our Service

LEAD™ LMS provides a variety of tools and resources to support educational endeavors. These services are provided "as is" and are subject to change or termination without notice.

a. Account Registration

You must register for an account to access many of the features of LEAD™ LMS. You agree to provide accurate and complete information during the registration process and to keep that information up to date.

Age Restrictions

Users under the age of 13 are not permitted to create an account or use LEAD™ LMS without parental consent. By agreeing to these Terms, you represent that you are 13 years of age or older or have obtained parental or guardian consent to use our service.

b. Acceptable Use

You agree not to use LEAD™ LMS in any way that is illegal, harmful, or violates the rights of others.

2. Electronic Signatures

By using our services, you agree that your electronic signature is legally equivalent to a handwritten signature. This principle is supported by laws such as the Electronic Signatures in Global and National Commerce (ESIGN) Act and the Uniform Electronic Transactions Act (UETA), which affirm the validity and enforceability of electronic signatures. We securely store all signatures, along with records of the user who created them (or the user registered by the questionnaire), and encrypt all signature data to protect your information.

If you would like a copy of any e-signatures you have submitted to us and/or any related records, please make a request by emailing help@fivable.com, which we will respond to expediently. In the near future you will be able to download a PDF from the app itself.

3. Intellectual Property

All content on LEAD™ LMS is the property of or licensed to us and is protected by copyright and trademark laws.

4. Privacy Policy

Your privacy is important to us. This section explains how we collect, use, protect, and share your personal information.

a. Information Collection

We collect information you provide directly to us, such as when you create an account, and information we collect through your use of our services, like your progress through courses.

b. Use of Information

The information we collect is used to provide, maintain, and improve our services, to develop new services, and to protect our users and ourselves.

c. Sharing of Information

We do not share personal information with companies, organizations, or individuals outside of LEAD™ LMS except in the following cases:

  • With your consent.

  • For external processing by trusted partners, under confidentiality agreements.

  • For legal reasons, like to meet any applicable law, regulation, legal process or enforceable governmental request.

d. Data Security

We work hard to protect your information from unauthorized access, alteration, disclosure, or destruction and have implemented various measures to do so.

If you would like any additional information on our data security protocols or would like us to provide or delete your personal data from LEAD™, please contact us at privacy@fivable.com.

5. SMS Communications

LEAD™ LMS offers optional SMS (text message) capabilities to provide users with reminders and updates regarding their learning requirements, as well as an SMS verification code login option. By opting in to receive SMS communications, you agree to the terms outlined in this section.

a. Opt-In Process You may choose to receive SMS messages by providing a valid phone number during initial account registration or by editing your user profile. During registration, you will be presented with the option to check a box stating, "I would like to receive text reminders and updates regarding my learning requirements." When editing your profile, you will see an option to check a box labeled "Accept SMS text messages." These checkboxes represent your explicit consent to receive SMS communications from LEAD™ LMS. You will only receive SMS messages if you affirmatively opt in through one of these methods.

b. Opt-Out Process You may opt out of receiving SMS messages at any time by updating your preferences in your user profile. Upon opting out, we will cease sending SMS communications to your phone number.

c. Costs and Carrier Charges LEAD™ LMS does not charge you directly for SMS messages; however, standard messaging and data rates may apply as determined by your mobile carrier. You are responsible for any fees charged by your carrier for receiving SMS messages.

6. Limitation of Liability

LEAD™ LMS will not be liable for any damages arising from your use of the platform.

7. Amendments

LEAD™ LMS reserves the right to amend these terms at any time, and you agree to be bound by such amendments.

8. Governing Law

These TOS are governed by the laws of South Carolina.
